Your problems as claimant

Everyone can encounter a situation where it is necessary to enforce a claim against a third party in a time-consuming trial.

Some examples: 

  • You are involved in a traffic accident through no fault of your own and are badly injured. The other party however claims that it is your fault.
  • You want to accept your inheritance but your fellow heirs argue that the will that favors you is legally void.
  • You did the work as provided in your contract and billed it accordingly. Your customer does not pay, pointing to own outstanding receivables.
  • For years, you paid your disability insurance. But when you want a claim to be approved for benefits, the insurer points to a medical history you allegedly kept secret and refuses to pay.
  • You acted in an official, governmental capacity and caused damage. The local authority however refuses compensation.

If you do not want to abandon your claims and demands in these cases, you will need professional legal and judicial assistance. Depending on the value in litigation, you have to advance a large amount of money and possibly finance a costly expert’s report.

And yet, it is uncertain that you will win the legal dispute in court. In the event that you are defeated in the judicial proceedings, you lose all entitlements for demands and you have to pay both your own litigation costs and those of your opponent. But even if you win, you could go away empty-handed. Your opponent could suffer from a deterioration of his or her assets. As primary debtor, you then would be liable for your court and lawyer fees.

If you cannot raise this amount of money yourself, your defense insurance does not want to cover the costs and legal aid is out of the question, you have to waive your claims, even though they are justified.
